| GENERAL TERMS & CONDITIONS 1 Prices
Goods are invoiced at the price ruling at the date of dispatch or at the contract price if delivery is as specified. Prices shown do not include sales tax. Sales tax will be added for all goods shipped within the state of Tennessee. 2 Orders
All orders are accepted subject to these terms and conditions
3 Shipping
All shipping costs are charged extra and delivery will be to the premises specified on the purchase order. 4 Quotations
Quotations are valid for 30 days from issue unless otherwise specified 5 Damage
Any claims of damage in transit or short delivery must be notified to us and to the carrier by letter within 10 days. Claims of non-delivery must be made within 7 days of receipt of invoice. Claims that goods or materials are delivered defective or not in accordance with the order as accepted must be made within 7 days of delivery, failing which we shall have no liability in this respect. 6 Replacement
Any goods supplied will be replaced free of charge, repaired as new or at our absolute discretion the purchase price refunded if we are reasonably satisfied that such goods were defective in materials or workmanship or were otherwise not in accordance with contract. 7 Title
Risk in goods sold shall pass to the customer at the time of delivery. Property in the goods sold shall pass to the customer when payment is made in full for them. If the customer shall default in the punctual payment of any sum due to us we shall be entitled to repossess any goods which remain our property. 8 Payments
Payments shall be made within 30 days from invoice date. Late payments shall be subject to credit charges equivalent to 5% above published clearing bank base rates to run from such time as amounts become overdue. 9 Warranty
Goods supplied are offered with the benefit of available manufactures warranties. 10 Development
As part of our policy of continuous development we reserve the right to make alterations in the design and specifications of goods. 11 Sale-or-Return
Goods are not supplied on sale-or-return basis unless agreed by an officer of the Corporation in writing prior to dispatch of the goods. 12 Returns
Goods will not be accepted back for credit unless a return authorization number has been issued in writing by an employee of the Corporation prior to return. Shipping will not be credited. A handling charge of 20% or $5.00 whichever is greater will be applied to orders part-cancelled after dispatch. Goods will only be accepted if received within 30 days of authorization undamaged and in new condition. Damage in transit for returns is the liability of the customer. 13 Liability
No liability is accepted express or implied for any consequential loss arising from use or misuse of any system or part of any system or goods supplied. Jack Roe USA Inc.'s maximum liability shall be limited to the purchase price paid by the customer or part thereof relating to the element(s) in question. It is the customer's responsibility to ensure that users of products are fully trained in all aspects of their use including matters of Health & Safety 14 Jurisdiction
Sale is deemed to have been made in Tennessee in the United States of America. Should any part of our conditions be later deemed to be not within established U.S. Law, the remainder shall not be held as invalidated. Only the laws of the United States of America shall apply. |
